Welcome to RoketViral (“RoketViral,” “we,” “our,” or “us”). By accessing or using the RoketViral mobile application, websites, APIs, and related services (collectively, the “Service”), you (“you,” “User”) agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
1. Description of the Service
RoketViral is an AI-powered creator tool that may provide:
- Viral probability predictions and scoring
- Video/content analytics and performance insights
- AI-generated feedback and improvement suggestions
- Posting/upload assistance and scheduling to supported social platforms
- Performance tracking and workflow features
RoketViral does not guarantee virality, accuracy, performance improvements, or any specific results. Outputs are informational and advisory only.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement.
3. Accounts, Security, and Access
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity under your account
- Ensuring your device and account are secured
We may suspend or terminate access if we reasonably believe your account is compromised, being misused, or violating these Terms.
4. Social Media Integrations and Third-Party Platforms
RoketViral allows you to connect third-party social media accounts. You can find a current list of supported platforms and the specific terms governing those connections on our Third-Party Services page.
4.1 Data Access and Usage
RoketViral uses your email address to create and manage your account. When you connect a social media account, RoketViral accesses the name of the page or channel you select so it can be identified and displayed within the app. RoketViral also accesses analytics and performance data from connected social media accounts, such as views and engagement metrics. This information is used to provide performance tracking, analytics, personalized insights, and recommendations within RoketViral. See our Privacy Policy for more information about how your data is accessed and used.
4.2 Your Control and Revocation
You control your connected accounts. You may revoke RoketViral's access to your connected social media accounts at any time via the platform’s security settings or directly within the Service. Once access is revoked, we can no longer access your platform data.
4.3 Platform Rules
Your use of third-party platforms remains subject to those platforms’ own terms and policies. RoketViral is not responsible for platform actions—including content removal, account flags, suspensions, or API limitations—resulting from your use of their services or your non-compliance with their rules.
5. AI Processing & Third-Party Systems
To provide analytics and insights, RoketViral uses third-party artificial intelligence systems. A current list of our AI providers and their respective service scopes is maintained on our Third-Party Services page.
By using AI features, you acknowledge and agree that:
- Your content (videos, metadata, and transcripts) may be transmitted securely to our AI service providers to generate requested insights.
- AI outputs are advisory and may contain inaccuracies or errors; you are solely responsible for how you use these outputs.
- We do not control the internal operations of third-party AI models and are not responsible for provider-side behavior.
- We do not use your content to train these third-party models for general public use.
If you do not consent to this processing, please refrain from using AI features or uploading content for AI analysis.
6. User Content
6.1 Your Rights in Your Content
You retain ownership of content you upload or submit to the Service (“User Content”), subject to the license you grant below.
6.2 License You Grant to RoketViral
To operate the Service, you grant RoketViral a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, transmit, and display your User Content only as needed to:
- Provide analytics and AI processing you request
- Generate predictions, insights, and recommendations
- Enable scheduling/upload and publishing actions you initiate
- Maintain and improve Service functionality and security
This license ends when your User Content is deleted from our systems (subject to limited retention described in the Privacy Policy, backups, and legal/compliance needs).
6.3 Content You Publish to Platforms
If you publish content through the Service to a third-party platform, that platform may store and process it under its own policies. RoketViral is not responsible for third-party platform retention, sharing, or distribution once posted.
7. Acceptable Use and Prohibited Conduct
You agree not to use the Service to:
- Upload or distribute unlawful, exploitative, hateful, violent, or abusive content
- Infringe intellectual property, privacy, publicity, or other rights of others
- Harass, threaten, defame, or impersonate any person or entity
- Attempt to bypass security, access data not belonging to you, or probe/scan vulnerabilities
- Reverse engineer, extract source code, or misuse the Service or AI systems
- Automate usage in a way that materially strains or disrupts the Service
- Generate or promote deceptive or fraudulent activity (including spam or platform manipulation)
Violations may result in suspension or termination.
8. Predictions, Analytics, and No Guarantees
RoketViral may provide AI-generated outputs including:
- Viral probability scores and engagement predictions
- Trend/timing recommendations
- Caption/title/hashtag suggestions
- Content optimization insights
You acknowledge and agree that:
- Outputs are not guarantees of performance or results.
- You are solely responsible for how you use outputs and what you publish.
- RoketViral is not liable for your creator performance, business outcomes, or platform consequences.
9. Subscriptions, Billing, and Virtual Items
9.1 Payment Processing
Subscriptions and purchases of digital goods... are facilitated primarily through the Apple App Store or Google Play Store billing systems. We reserve the right to offer additional payment methods or processors as the Service evolves.
9.2 Subscription Terms
- Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle unless managed or canceled through your app marketplace account settings at least 24 hours prior to the renewal date.
- Access After Cancellation: Canceling stops future renewals. You will retain access to your paid features until the conclusion of your current billing period.
9.3 Virtual Items (Utility Tokens)
The Service may feature "utility tokens" or other virtual items used for app functionality. These items hold no real-world cash value, cannot be redeemed for legal tender, and are non-refundable and non-transferable. We reserve the right to manage, regulate, control, modify, or eliminate these virtual items as we see fit.
9.4 Pricing and Modifications
We may adjust our pricing, plans, or features at our discretion. Marketplace providers will manage billing adjustments in accordance with their respective policies.
9.5 Refunds
All purchases are final and non-refundable, except where mandatory applicable law or the specific refund policy of the marketplace (Apple or Google) requires otherwise. All refund requests must be directed to the marketplace provider according to their respective procedures.
10. Privacy
Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and retain information (including temporary video storage, analytics retention windows, and social platform data access).
11. Intellectual Property
The Service (including all source code, software, proprietary algorithms, designs, trademarks, logos, and our proprietary scoring and analytics systems) is the exclusive property of its respective owners and/or licensors. RoketViral is authorized to use and operate these assets under license. You do not acquire any ownership interest in the Service by using it, and all rights not expressly granted to you under these Terms are reserved.
12. Termination
We may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, or create risk or legal exposure for RoketViral or others. You may stop using the Service at any time.
Termination may not automatically cancel an active subscription; you must cancel through your account billing method.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROKETVIRAL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that outputs will be accurate or reliable.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROKETVIRAL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, FOLLOWERS, VIEWS, ENGAGEMENT, OR BUSINESS OPPORTUNITIES.
TO THE EXTENT PERMITTED BY LAW, ROKETVIRAL’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO ROKETVIRAL FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR, IF NONE, $100).
(Some jurisdictions do not allow certain limitations; in those cases, limitations apply to the extent permitted.)
15. Indemnification
You agree to indemnify and hold harmless RoketViral from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.
16. Modifications to the Service or Terms
We may modify the Service and/or these Terms from time to time. If we make material changes, we will provide notice as required by law. Continued use after changes become effective constitutes acceptance.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted on an individual basis, and you waive the right to participate in any class action lawsuit or class-wide arbitration. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
